New Acknowledgment Requirements for 2008
Assembly Bill 886 (Chapter 399, Statutes of 2007) was signed into law and makes several significant changes in current notarial law, including the amendment of Civil Code section 1189 as described below.
Effective January 1, 2008, the identity of the person making the acknowledgment may no longer be established by personal knowledge alone. Civil Code section 1185. The certificate of acknowledgment is now executed under penalty of perjury and must be in the form set forth in Civil Code section 1189.
